Notice of Privacy Practices

How health information may be used or disclosed when applicable, and the privacy rights that may apply to established Ohr Wellness services.

This notice describes privacy practices for health information handled by Ohr Wellness. When the HIPAA Privacy Rule applies to Ohr Wellness, this notice is intended to describe the rights and responsibilities required by that rule. State or other laws may provide additional protections.

Your rights

Subject to applicable law, you may have the right to inspect or obtain a copy of certain health records, request correction of certain information, request confidential communications, ask for certain restrictions, request an accounting of certain disclosures, obtain a paper or electronic copy of this notice, choose a personal representative, and file a privacy complaint without retaliation.

Get a copy of your health and claims records

You may ask to see or obtain an electronic or paper copy of health information maintained by Ohr Wellness that you are legally entitled to access. Fees and response times are governed by applicable law.

Ask us to correct information

You may ask Ohr Wellness to correct health information that you believe is incorrect or incomplete. Ohr Wellness may deny a request when permitted by law and, when required, will explain the reason.

Request confidential communications or restrictions

You may ask Ohr Wellness to contact you in a specific way or at a specific location and may request limits on certain uses or disclosures. Some requests must be honored by law; others may be accepted or denied depending on the circumstances.

Your choices

For certain uses and disclosures—such as some communications with family or friends, certain marketing activities, or uses not otherwise permitted by law—Ohr Wellness may ask for your written authorization. You may revoke an authorization as permitted by law.

How health information may be used or shared

When legally permitted, health information may be used or disclosed for treatment and care coordination, payment and billing, healthcare operations, public-health and safety activities, legal and regulatory obligations, workers’ compensation or similar programs, and other purposes permitted or required by law. Ohr Wellness will limit uses and disclosures as required by applicable privacy rules.

Additional protections

Certain categories of information may receive additional protections under federal or state law. For example, certain substance use disorder patient records may be subject to additional requirements under 42 CFR Part 2 when applicable. Ohr Wellness will follow laws that impose stricter privacy protections than the general rules described in this notice.

Our responsibilities

  • Maintain the privacy and security of protected health information as required by applicable law
  • Provide notice if a breach occurs when notification is legally required
  • Follow the privacy practices described in the notice currently in effect
  • Not use or share information for purposes requiring authorization without obtaining that authorization
  • Use appropriate agreements and safeguards with vendors that handle protected health information on behalf of the practice when required

Practice Better and secure communications

Ohr Wellness uses Practice Better for client scheduling, intake, forms, portal access, and secure messaging. Existing clients should use the secure portal for clinical information when available rather than ordinary email.

If HIPAA applies, you may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. Ohr Wellness will not retaliate against you for filing a good-faith privacy complaint.

Changes to this notice

Ohr Wellness may change its privacy practices and this notice as permitted by law. When required, an updated notice will be made available to clients and prominently posted on this website.
